Terms of Service

The short version

These terms cover censusrise.com and the community-branded care assessment and tour booking pages we operate at ourcareguide.com.

If you are a family researching care, the parts that matter to you are Section 4 (we give guidance, not medical advice) and Section 6 (text messages, and how to stop them).

If you are a senior living community paying for CensusRise, your signed service agreement is the real contract. These terms fill in around it, and where the two disagree, the signed agreement wins.

01Agreement to these terms

These Terms of Service (the “Terms”) are a legal agreement between you and For Impact Co, LLC, doing business as CensusRise (“CensusRise,” “we,” “us,” or “our”). They govern your use of censusrise.com, ourcareguide.com, the care assessment and tour booking pages we operate for senior living communities, our client dashboard, and the messages we send through those systems (together, the “Services”).

By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

If you accept these Terms on behalf of a company or organization, you confirm you have authority to bind it, and “you” means that organization.

02Who these terms cover

Two different groups use the Services, and different sections apply to each:

  • Families and individuals researching senior living, completing a care assessment, booking a tour, or exchanging messages with us.
  • Community customers — senior living communities and their staff who subscribe to CensusRise.

Sections 9 and 10 apply only to community customers. Everything else applies to everyone.

For community customers, a separate written service agreement governs the commercial relationship — fees, term, the performance guarantee, exclusivity, and what each side commits to. These Terms supplement that agreement. If anything here conflicts with your signed agreement, the signed agreement controls.

03What we do, and what we don’t do

CensusRise provides senior living communities with a branded care assessment, a tour booking system, automated follow-up by text and email, and reporting. Families use those tools to describe what they are looking for and to schedule a visit with a community.

Some things we specifically do not do:

  • We are not a referral service. We do not charge families anything, we do not receive placement fees, and we do not sell or broker leads.
  • We do not operate senior living communities and we do not provide care of any kind.
  • We do not manage advertising for our community customers. Communities run their own campaigns and control their own budgets.
  • We do not guarantee a move-in. Whether a family chooses a community, and how that community responds, is outside our control.

04Not medical, legal, or financial advice

The care assessment is an informational tool. It suggests where families in similar situations usually start — for example independent living, assisted living, or memory care. It is not a medical evaluation, a diagnosis, a clinical assessment, or a determination of the level of care any person requires.

Nothing in the Services is medical, legal, financial, or tax advice. Decisions about a person’s care should be made with qualified professionals and with the community itself, which will conduct its own assessment before anyone moves in.

Messages you receive may be generated by an automated digital assistant, described in our Privacy Policy. It answers from information the community has provided. It can be wrong, and it is not a substitute for speaking to the community’s staff. Always confirm pricing, availability, and care details directly with the community before relying on them.

We do not use assessment answers to steer families toward or away from any community on the basis of race, color, religion, sex, familial status, national origin, disability, or any other characteristic protected by fair housing or civil rights laws.

05Eligibility

You must be at least 18 years old to use the Services. By using them, you confirm that you are. If you provide information about another person, such as a parent or spouse, you confirm you are entitled to share it.

06Text messaging (SMS) terms

By providing your mobile number and checking the consent box on a care assessment or tour booking form, you agree to receive text messages from us on behalf of the community you contacted.

FrequencyMessage frequency varies based on your inquiry and how you reply.
CostMessage and data rates may apply. We do not charge for messages; your mobile carrier may.
Opt outReply STOP to any message. You will receive one confirmation and then no further texts.
HelpReply HELP, or contact us using Section 19.
CarriersMobile carriers are not liable for delayed or undelivered messages.
SupportedMajor U.S. carriers. Availability may vary and is not guaranteed on every carrier or device.

Consent to receive text messages is not a condition of any purchase, of touring a community, or of using the Services.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services, such as customer service and message delivery, is permitted. Text messaging originator opt-in data and consent are excluded from all sharing and will not be shared with any third parties.

Opting out of texts does not opt you out of email; those are separate. If you change or give up your mobile number, please tell us, so we do not message someone who never consented. Full detail on how we handle this information is in our Privacy Policy.

07Email communications

We send transactional email — assessment results, booking confirmations, reminders — and, where permitted, occasional messages about the community you contacted or, for community customers, about our services. You can unsubscribe from marketing email using the link in any such message. Transactional email about something you actively requested may still be sent.

08Acceptable use

You agree not to:

  • Submit false information, impersonate anyone, or book tours you have no intention of attending.
  • Use the Services to send unlawful, harassing, deceptive, or abusive content.
  • Scrape, copy, resell, or systematically extract any part of the Services or the data in them.
  • Attempt to gain unauthorized access to our systems, or probe, scan, or test their security.
  • Interfere with the Services, introduce malicious code, or place unreasonable load on our infrastructure.
  • Reverse engineer any part of the Services, or use them to build a competing product.

We may suspend or remove access for anyone who does these things.

09Subscriptions, billing and cancellation

This section applies to community customers.

  • Subscription. CensusRise is billed monthly in advance. Your signed service agreement states your rate.
  • No long-term contract. Subscriptions are month to month unless your agreement says otherwise. You may cancel effective at the end of your current billing period.
  • No partial refunds. Cancelling stops future billing. We do not refund the current month, and fees already paid are non-refundable except where required by law.
  • Payment. You authorize us to charge your payment method on file for each period until you cancel. If a payment fails, we may retry and may suspend the Services until it clears.
  • Taxes. Fees exclude applicable taxes, which you are responsible for.
  • Price changes. We may change pricing for future billing periods with at least 30 days’ notice. Rates locked in writing in your agreement are honored for as long as that agreement says.
  • On cancellation. We will make your lead and booking data available for export for 30 days, after which we may delete it.

10Performance guarantee and exclusivity

This section applies to community customers.

We offer a performance guarantee based on booked tours, and territory exclusivity, to communities that qualify. The exact terms — the number of tours, the time window, the territory, the remedy, and the commitments you must meet for it to apply — are set out in your signed service agreement, and only there.

Two things are true of the guarantee in every case, and we state them here so there is no confusion:

  • The remedy is our continued work, not money. The guarantee is not a refund and does not create a right to a refund or credit.
  • It depends on your inputs. The guarantee is conditioned on the community meeting its own commitments, including the agreed advertising spend and responding to booked leads within the agreed time. If those are not met, the guarantee does not apply.

We measure booked tours on the booking system we operate. We do not guarantee move-ins, occupancy, revenue, or any financial outcome, because those depend on your team and on decisions families make.

Marketing statements on our website are summaries. They do not modify your signed agreement and are not themselves a contractual promise.

11Your content and our intellectual property

Yours stays yours. Community customers keep ownership of their logos, photography, pricing, care details, and lead data. You grant us the license needed to host and display that material and to operate the Services for you.

Ours stays ours. The CensusRise platform, software, assessment logic and question design, templates, brand, and documentation belong to us. Nothing here transfers ownership of them.

We may use aggregated, de-identified data — information that does not identify any individual or any single community — to operate, benchmark, and improve the Services.

12Communities and third-party services

When you submit an assessment or book a tour, your information goes to the community you contacted. That community is independent of us. We are not responsible for its pricing, availability, care, staffing, admissions decisions, how quickly it responds, or how it handles your information once it has it.

The Services rely on third-party providers for hosting, messaging, scheduling, and payments. Their performance is outside our control, and outages or errors on their side may affect the Services.

13Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT MESSAGES WILL BE DELIVERED, OR THAT ANY INFORMATION PROVIDED THROUGH THE SERVICES IS ACCURATE OR COMPLETE.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

14Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CENSUSRISE AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, OCCUPANCY, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

15Indemnification

You agree to indemnify and hold harmless CensusRise and its officers, members, and employees from any claims, damages, losses, and reasonable legal fees arising out of your use of the Services, your violation of these Terms or of any law, or your infringement of anyone’s rights. For community customers, this includes claims arising from the content, pricing, and care information you give us to publish, and from your own handling of family information after we pass it to you.

16Suspension and termination

We may suspend or terminate access to the Services at any time if you breach these Terms, if we are required to by law, or if continuing would create risk for us, for a community, or for families using the Services. Community customers may cancel as described in Section 9.

Sections that by their nature should survive termination — including Sections 11, 13, 14, 15, and 17 — will survive.

17Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules.

Any dispute arising out of or relating to these Terms or the Services must be brought exclusively in the state courts located in Cherokee County, Georgia — or, for any matter within the exclusive jurisdiction of the federal courts, in the United States District Court for the Northern District of Georgia. You and CensusRise each consent to personal jurisdiction in those courts and waive any objection to venue or to the forum being inconvenient.

Before filing anything, please contact us. Most disputes can be resolved quickly by email. We ask that you give us 30 days to resolve a dispute informally, and we will do the same for you.

18Changes to these terms

We may update these Terms from time to time. We will update the “Last updated” date above, and for material changes affecting community customers we will give notice by email. Your continued use of the Services after an update means you accept the revised Terms.

These Terms, together with the Privacy Policy and, for community customers, your signed service agreement, are the entire agreement between us on this subject. If any provision is found unenforceable, the rest stays in effect.
